Teacher and teacher leader discipline hearings

A disciplinary hearing is one of the possible outcomes of an investigation by the Alberta Teaching Profession Commission.

About hearings

Teacher and teacher leader disciplinary hearings are conducted by members of the Professional Conduct and Competency General Panel. Hearings stem from investigations by the Alberta Teaching Profession Commission. They can also be ordered by a complainant appeal committee.

When a complaint is referred to a hearing, the chair of the Professional Conduct and Competency General Panel forms a hearing committee to review it. Hearings are conducted in accordance with processes set out in the Education Act, the Professional Conduct and Competency of Teachers and Teacher Leaders Regulation and in rules of procedural fairness.

Hearings are open to the public unless:

  • the complainant requests that the hearing be held in private for reasons of confidentiality, or
  • the interests of any individual, other than the teacher or teacher leader who is the subject of the hearing, may be negatively impacted if the hearing is public.

Following a hearing, the hearing committee may determine:

  • there was unprofessional conduct or professional incompetence and recommend a penalty, or
  • there was no wrongdoing and recommend the complaint be dismissed.

Based on the findings, the hearing committee makes a recommendation to the Minister of Education and Childcare to make a final decision. All parties are given a written copy of the decision.

Findings of professional incompetence and/or unprofessional conduct are posted to the Teacher and Teacher Leader Registry. The professional standing of an Alberta certificated teacher can also be found on the registry.

An appeal committee may review the decision of a hearing committee at the request of involved parties.

Attending a hearing

Most hearings are open to the public. To attend a hearing, members of the public must submit a hearing attendance request form at least 5 days before the hearing.

Fill out the form that corresponds with the type of hearing you would like to attend:

You will be provided with login instructions after your request is approved.

Seating for in-person hearings is limited and assigned on a first-come, first-served basis. The location will be provided to parties and members of the public who submit a hearing attendance request form.

In accordance with section 225.996 of the Education Act, the hearing committee may decide to close the proceedings to the public.

Check back regularly as the public hearings schedule changes often. Hearings may be rescheduled on short notice.
