Appealing commissioner or hearing committee decisions

Complainants and teachers or teacher leaders involved in complaints can appeal decisions in the disciplinary process.

Information on the process for appealing commissioner or hearing committee decisions, applicable fees and payment details.

Complainant appeals

A person who has filed a complaint about teacher or teacher leader conduct or incompetency can appeal a decision by the commissioner of the Alberta Teaching Profession Commission to take no further action on the complaint.

Appeals must be filed within 15 days of receiving notification of the commissioner's decision, along with payment of the $250 appeal fee. If the appeal or fee payment is received after this period, the appeal may be dismissed.

To file an appeal, a complainant must email a notice of complainant appeal to the chair of the Professional Conduct and Competency General Panel at [email protected].

The notice of appeal must be in writing and state the reason(s) for the appeal.

How to pay the fee

Complainant appeal fees can be paid using the following methods:

  • Credit card (Visa, Mastercard or American Express) by requesting a link from [email protected].
  • Personal or company cheque, money order or bank draft payable to the "Government of Alberta".

Where a cheque is non-sufficient funds (NSF), the appeal fee must be paid by money order.

Refund

The appeal fee will be refunded if the appeal is successful or:

  • the appeal fee is paid but no notice of complainant appeal is filed within the 15-day period after notification
  • the appeal is withdrawn after a hearing date has been set but before the hearing has commenced

Appeals of hearing committee decisions

Teacher or teacher leaders who are the subject of a hearing committee decision can submit formal review requests to the chair of the Professional Conduct and Competency General Panel.

  • The commissioner of the Alberta Teaching Profession Commission may also submit a request to review a hearing committee’s decision.

There is no fee for appeals of hearing committee decisions.

Appeals of hearing committee decisions must be filed within 15 days of receiving the decision by emailing a notice of appeal to the chair of the Professional Conduct and Competency General Panel at [email protected].
