This web site ("Site") is owned and operated by Her Majesty the Queen in Right of Alberta, as represented by Alberta Health (“Alberta Health”). By using the Site, you, the user agree to the following terms and conditions (“Terms & Conditions”). If you do not agree to all of the Terms & Conditions, please discontinue your use of the Site immediately.

If you have authorization to use the Site to access another individual’s Covid Records on their behalf, and you are using the Site for that purpose, then references to “you” in these Terms and Conditions and elsewhere on the Site include that individual.

Alberta Health and its agents, suppliers, service providers and other representatives are all together referred to as “we” or “us” in these Terms and Conditions.

Alberta Health may change the content of the Site, including all text, data, information, recordings, graphics, images, icons, features, functions, and any other content (collectively, the “Content”) at any time without notice. These Terms & Conditions may be revised by Alberta Health at any time without notice.

Restrictions on use

You agree that your use of the Site shall not violate any applicable local, national or international law. If you violate any of the Terms & Conditions, your limited license to use the Content will automatically terminate, and you must immediately cease your use of the Site and destroy any copies of the Content or any portion thereof.

In addition, you agree that you will not use the Site for any purpose other than that for which it was intended and you agree you will not:

(i) use the Site to impersonate another person, or otherwise attempt to gain unauthorized access to another individual’s health information or to infringe the intellectual property or any other rights of any third party;

(ii) interfere with or disrupt the integrity or performance of the Site or the data contained therein;

(iii) reverse engineer, disassemble, de-compile, modify, translate, create derivatives of, disassemble or use for competitive analysis the Site;

(iv) access, copy or use the Site in order to build a competitive product or service, or copy any Content, including features, functions or graphics;

(v) license, sublicense, sell, resell, rent, lease, transfer, assign, distribute, time-share or otherwise commercially exploit or make the Site available to any third party, or purport to do any of these;

(vi) remove, alter, or obstruct copyright notices, trademarks or other legends on the Site or Content;

(vii) in using the Site, intentionally send or store: (a) spam or otherwise duplicative or unsolicited messages in violation of applicable laws, (b) infringing, obscene, threatening, harassing, abusive, slanderous, hateful, libelous, or otherwise unlawful or tortious material, including material that is harmful to children or violates third-party privacy rights, or (c) malicious or harmful code, including but not limited to viruses, worms, time bombs, Trojan horses and other harmful or malicious code, files, scripts, agents or programs;

(viii) attempt to gain unauthorized access to the Site or its related systems or networks; or

(ix) create internet links to the Site or copy, frame or mirror any part of the Site (or any source code or object code thereof).

Modifying or discontinuing this service

We reserve the right to modify or discontinue (temporarily or permanently) this service (or any part of it) with or without prior notice to you.

Accuracy and integrity of information

Although Alberta Health attempts to maintain the integrity and accuracy of the Site, we do not make any guarantees whatsoever as to its integrity or accuracy. The Covid Records provided through the Site represents the data that has been provided to Alberta Health. It is possible the Site could include typographical errors, inaccuracies or other errors. Privacy

We will use your health information as necessary to provide you Covid Records.

We use reasonable efforts to maintain the confidentiality and privacy of individuals' health information while collecting, using, and disclosing information in compliance with the Health Information Act. We support the right of individuals or their authorized representatives to access and request corrections to their health information, subject to any specific restrictions in applicable legislation.

We will not collect, use, or disclose health information in any manner that is not in accordance with the Health Information Act and our established policies.

Disclaimer

The materials on this Site are provided "as is" without warranties, covenants or conditions of any kind either expressed or implied. To the fullest extent possible under applicable law, we disclaim all warranties and conditions, expressed or implied, by operation of law or otherwise, including but not limited to, implied warranties or conditions of merchantability and fitness for a particular purpose, non-infringement or other violation of rights. We do not warrant or make any other representations regarding the use, accuracy, timelines, applicability, performance, security, availability or reliability of this Site, or the results from the use of this Site, or otherwise respecting the materials on this Site.

Jurisdiction

This Site is administered by Alberta Health, which is located in Alberta, Canada. Any matter arising out of the use of this Site shall be governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without reference to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts of the Province of Alberta to determine any action or proceeding arising out of or in connection with this Site.
