Periodically, Crown land is made available for the public to bid and win the right to hold a disposition.

Overview

Forestry and Parks (the Ministry) routinely reviews applications for agriculture dispositions as submitted through a Land Review Request (LRR). When a decision to allocate land under a Grazing lease (GRL), Grazing Licence (FGL), or Farm Development Lease (FDL) disposition is made, the ministry has two options for the public to bid on public lands for the right to hold a disposition – auctions and tenders.

Auctions

General information

  • The successful bidder, upon award of the disposition, will be responsible for all applicable fees, rent and royalties under the Public Lands Act.
  • All details including names and amounts become public information after completion.
  • The ministry reserves the right to cancel the auction without prior notice to the public.
  • The ministry reserves the right to withdraw any of the lands from the auction, or to include any other lands therein.
  • The ministry, at its sole discretion, may deem a bid incomplete or incorrect per these requirements, and reject it.

Requirements

  • Individual bidders must be 18 years of age or older and a Canadian citizen or permanent resident of Canada.
  • Bidders who are Government of Alberta employee(s) are to follow section 24 of the Public Service Act and adhere to the Code of Conduct and Ethics for the Public Service of Alberta.
  • The minimum bid is $10,000 plus GST.
  • The disposition will be issued to the successful bidder only in the name(s) listed on the Crown Land Disposition Auction Declaration form. Changes will not be accepted.
  • A bidder who is a company, corporation, or association must be registered in the Alberta Corporate Registry and be authorized to conduct business in Alberta.
  • The bidder must not be indebted to the province under any disposition in the name of the bidder granted under the Public Lands Act (Alberta).
  • The bidder must be in compliance with the terms of all dispositions in the name of the bidder granted under the Public Lands Act (Alberta), whether sole or with other disposition holders.

Conditions

  • Submitted bids may not be withdrawn or countermanded.
  • Access to the land under disposition is not included as part of the disposition. The successful bidder is responsible for ensuring that access to the land under disposition is available and suitable for their intended use.
  • The successful bidder will be issued a disposition for a 10-year term and is responsible for payment of a $125.00 mapping fee, annual municipal taxes, and annual rent.
  • The successful bidder must complete any remaining application requirements specified by the ministry within 10 days of request.
  • The disposition will be subject to the legislation and must be grazed by livestock (that is, cattle, horses, and sheep) solely belonging to the disposition holder.
  • The acquisition of a disposition does not convey the right to graze bison. To graze bison on the land, additional written approval from the Ministry is required.
  • The grazing licence holder has exclusive use of the area for grazing only. The ministry or other regulatory bodies, may issue additional dispositions to any person authorizing that person to enter onto, use and occupy the lands for various purposes including, but not limited to, the extraction and removal of merchantable resources, or to conduct development, including, but not limited to mineral resource development.
  • Normal fencing and utilization requirements will apply, and no range improvement may be carried out on the land unless prior written approval has been obtained from the ministry.
  • The Line Fence Act applies and arrangements with the adjoining landowners or former occupant(s) regarding the use or purchase of any perimeter fences is the responsibility of the successful bidder.
  • The ministry may specify other requirements at its discretion.

Tenders

General information

  • The ministry reserves the right to cancel the tender without prior notice to the public.
  • The ministry reserves the right to withdraw any of the lands from the tender, or to include any other lands therein.
  • The ministry, at its sole discretion, may deem a bid incomplete or incorrect per these requirements, and reject it.
  • Calls for tenders are listed below by unit number, for example, Agriculture-2024-Unit 1.
  • Each unit number is a separate call for tenders.
  • Bidders may tender one bid per unit.
  • If bidders wish to bid on more than one unit, they must submit a separate tender bid submission in a separate envelope for each unit number.
    • All bids must include a completed Crown land tender/bonus bid form.
    • Public opening of the tenders will take place immediately following tender closing in Boardroom 5A, 5th Floor, 9915 108 Street, NW Edmonton, Alberta  T5K 2G8.
    • The minimum bid is $2,000.00 plus GST.

    • a return address
    • the tender unit name
    • the tender closing date
  • Each bid package must enclose:
    • a completed Crown land tender/bonus bid form specifying the tender unit number
    • payment (including GST) by certified cheque, money order or bank draft; and made payable to the Government of Alberta, quoting the tender unit name on the payment

  • The bidder has 10 business days after the tender to submit the completed, signed and properly commissioned forms to the ministry, along with supporting documents and the payment of the successful bid plus GST in full.
  • Following tender award, should the successful bidder fail to submit any requested items within 10 days, the minimum bid amount of $2,000.00 plus GST will be forfeit and no disposition will be issued. The balance of the tendered amount will be returned. The Ministry may then, at its discretion, either award the tender to the next most qualified bidder; re-offer the lands for auction or tender; or cancel the tender.
  • The disposition will be issued to the successful bidder only in the name(s) listed on the Crown land tender/bonus bid form Changes will not be accepted.
