Public Lands Appeal Board

You can make appeals to the Public Lands Appeal Board on certain land decisions made under Alberta’s Public Lands Act.

Overview

Alberta’s Public Lands Appeal Board is an independent, quasi-judicial regulatory review body that hears appeals to certain decisions made by the Alberta government regarding public lands access and use as defined under the following provincial legislation:

Certain public land decisions made by the Alberta government are appealable to the Public Lands Appeal Board.

Typical appeals reviewed by the board include disputes related to:

  • administrative penalties issued for misuse of public lands
  • the granting or refusal of public lands leases
  • orders to vacate public lands

You may also apply to the Public Lands Appeal Board for a road use decision in certain cases when you cannot reach an agreement for the use of a road on Crown land.

Appeal types and forms

Appeals are broadly categorized based on the time it takes to resolve them. In view of this, there are 3 types of appeals that may be submitted to the Public Lands Appeal Board:

  • General appeals: Simple appeals that are dealt with in 20 days.
  • Complex appeals: Appeals that are dealt with in 1 year. Most appeals are of this type.
  • Summary appeals: Particular appeals that are dealt with in 24 hours.
