Introduction
The Government of Alberta continues to review the Occupational Health and Safety (OHS) Code.
The OHS Code contains detailed technical requirements to protect worker health and safety at work sites. In 2020, the Government of Alberta developed a plan to update the OHS legislation, which aims to:
- Protect the health and safety of workers in Alberta.
- Make rules easy to understand and apply.
- Align Alberta’s OHS legislation with other Canadian jurisdictions.
- Empower work site parties to carry out their responsibilities for health and safety according to their level of authority and control.
- Correct errors, reduce duplication and conflict in requirements.
- Reduce unnecessary administrative burden.
This confidential survey will obtain input on proposed changes to Part 36 (Mining) of the OHS Code. Your input is vital to the review process and will inform recommendations for OHS Code changes.
Part 36 (Mining) contains requirements to address health and safety on mining work sites, including specific technical requirements for pits, above ground and underground mines.
While this part was recently updated in 2023, further updates to Part 36 were developed with input from stakeholders through a technical working group made of employers, workers and technical experts.
Changes proposed to Part 36 are intended to introduce new requirements to reflect best practices for health and safety and conditions on Alberta work sites, improve flexibility by changing prescriptive requirements to health and safety outcomes where appropriate, update existing or proposed new technical standards, clarify the responsibilities of work site parties, remove duplication, and clarify which requirements apply to which type of mine sites.
Some of the changes include moving provisions from Part 36 to Parts that apply to all industries, for example:
- Move the existing section 533.1, which requires an employer to implement and follow procedures and specifications certified by a professional engineer, to Part 3, Specifications and Certifications.
- Move the existing section 542, for the requirement for dumping blocks to prevent powered mobile equipment from going over an edge when discharging a load, to Part 19, Powered Mobile Equipment.

Editorial changes, such as simplifying wording, alignment with terminology, correcting errors, and removing duplication which do not change the requirements, are not included in the survey. Sections where no changes are proposed are also not included in the survey.
The survey wording will provide a summary of the proposed change with rationale but will not include proposed legal language. Final legal language will be drafted once consultation is complete.
