Overpayment and refunds

  • Small amounts ($10 or less)

    Court offices do not issue refunds of $10 or less. If the court made an error, a refund may be issued upon request. Otherwise, the funds are transferred to the Province.

  • Timing of refunds

    All refunds must be processed within the same fiscal year in which the payment was made.

  • Overpayments over $10

    Court offices will not issue a refund if any of the following apply:

    • the payment was made 6 months ago or more
    • the overpayment was not caused by a court system or clerical error
    • the documents have already been filed by a court clerk
    • the submission was not eligible for the Digital Service
    • the submission was reviewed by a clerk and then withdrawn through the Digital Service
    • the payment resulted from a duplicate submission
  • Application of funds

    Any overpayment received may be applied to other outstanding fines or fees owed by the payor.

  • U.S. currency payments

    Eligible refunds for payments made in U.S. dollars will be issued in Canadian currency, based on the applicable exchange rate.
