On Sept. 7, 2019, at approximately 12:18 a.m., Calgary Police Service (CPS) officers encountered two men rummaging through donation bins behind the Salvation Army Thrift Store at 3200 17th Avenue SE. Several items from the dumpster had apparently been thrown on the ground.
While the officers were checking the men’s identities, one man attempted to flee on foot. One officer pursued the man on foot while the involved officer joined the pursuit of the man in his marked police vehicle. While the man was running through a parking lot, he was struck by the police vehicle being operated by the involved officer.
The man was taken into custody. A medical examination determined that he had sustained several broken ribs and a fractured right wrist. It was subsequently determined that the man was wanted on a Canada-wide warrant.
The evidence gathered during ASIRT’s investigation provided reasonable grounds to believe that offences had been committed. As is required by the Police Act, the investigation was forwarded to the Alberta Crown Prosecution Service (ACPS) to determine whether the evidence met the standard for prosecution.
Following a review of the investigation and having been advised that the Crown was of the opinion that the evidence met their standard for prosecution, ASIRT executive director Susan Hughson, QC, made the determination that the involved officer should be charged. On Oct. 29, 2021, former Const. Lyndon Moore voluntarily attended at ASIRT, where he was arrested and charged with assault with a weapon, assault causing bodily harm, and operating a conveyance in a manner dangerous to the public causing bodily harm. He was released on an appearance notice and is scheduled for first appearance on Dec. 8 in Calgary Provincial Court.
As this matter is now before the courts, no further information will be released.
