Fleet Brake Parts & Service Ltd., as an employer, pleaded guilty on June 24 in the Edmonton Court of Justice to one count under the Occupational Health and Safety (OHS) Code for failing to ensure a worker was protected from falling. The Crown withdrew 13 other counts.

The Crown withdrew 14 counts against Parts for Trucks, Inc. related to the same incident.

The charges stem from an incident that occurred Jan. 22, 2024, at an Edmonton heavy-duty truck parts and service centre. A worker was seriously injured after being struck by a vehicle hood and then falling into an open drop pit.

The court fined Fleet Brake Parts & Service Ltd. $138,000, including the victim fine surcharge.

The company and the Crown have up to 30 days to appeal the conviction or penalty.

They provide guidance for employers to help them ensure their workplaces are as healthy and safe as possible while providing rights and protections for workers. Charges under OHS laws may be laid when failing to follow the rules results in a fatality or serious injury.
