Marigold Infrastructure Partners Inc., as an employer, pleaded guilty on May 26 in the Edmonton Court of Justice to one count under the Occupational Health and Safety (OHS) Code for failing to ensure equipment or material was contained, restrained or protected to eliminate potential danger. The Crown withdrew 13 other counts. The Crown also withdrew OHS charges against related entities Marigold Infrastructure Partners Limited Partnership and Marigold Infrastructure Partners LP.
The charges stem from an incident that occurred on the Edmonton Valley West Line LRT project on June 23, 2023. Workers were completing post-tensioning of a segment of LRT line when a worker was struck by equipment and seriously injured.
The court fined the company $120,000 including the victim fine surcharge.
The company and the Crown have up to 30 days to appeal the conviction or penalty.
Alberta’s OHS laws set basic health and safety rules for workplaces across the province. They provide guidance for employers to help them ensure their workplaces are as healthy and safe as possible while providing rights and protections for workers. Charges under OHS laws may be laid when failing to follow the rules results in a fatality or serious injury.
