Incident details

Two charges against Western Air Spray Inc., three charges against Bob (Bobby) Hnatko and one charge against Adam Giesbrecht, are the result of an incident that came to the attention of provincial investigators in January 2014.

The charges under the Environmental Protection and Enhancement Act and Pesticide (Ministerial) Regulation include:

  • Failure to report release of a substance that may cause, is causing or has caused an adverse effect into the environment, contrary to section 227 (j) of the Environmental Protection and Enhancement Act.
  • Commencing or continuing an activity requiring a registration without holding that registration, contrary to section 227 (j) of the Environmental Protection and Enhancement Act.
  • Providing a service involving the use or application of a pesticide without being the holder of a valid pesticide service registration as required by section 7(1)(a) of the Pesticide (Ministerial) Regulation, thereby committing an offence contrary to section 61 of the Environmental Protection and Enhancement Act.

The first court appearance is set for March 3, 2016 in Falher.
